1. Agreement to Terms

By accessing or using TattooRed ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

TattooRed is operated by AI Innovate Solutions, a company registered in England and Wales (Company Number: 15908901).

These Terms constitute a legally binding agreement. Please read them carefully.

2. Description of Service

TattooRed is an AI-powered tattoo design generation platform that allows users to:

• Generate custom tattoo design ideas using artificial intelligence
• Explore a gallery of AI-generated tattoo designs
• Chat with Red, our AI assistant, to refine tattoo concepts
• Save, download, and share generated designs
• Access tattoo style guides and inspiration

Important: TattooRed generates design ideas and inspiration. We are NOT a tattoo studio. Always consult a licensed, professional tattoo artist before getting any tattoo.

3. Account Registration & Eligibility

3.1 Eligibility

• You must be at least 18 years old to use TattooRed
• By creating an account, you represent that you meet this age requirement
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Security

• You are responsible for all activities under your account
• Notify us immediately at support@tattoored.com if you suspect unauthorized access
• We are not liable for losses due to stolen or compromised credentials

3.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Abuse the Service or harm other users
• Provide false information during registration

4. Subscription Plans & Payments

4.1 Free Plan

• Limited to 5 free generations per account
• Standard quality downloads
• Designs automatically published to community gallery
• Subject to change or removal at our discretion

4.2 Pro Plan

• Unlimited generations (subject to fair use policy—see Section 5.3)
• HD downloads
• Private gallery option
• Control over design publication
• Billed monthly or annually

4.3 Payment Terms

• Payments processed securely through Stripe
• All fees are in USD/GBP and non-refundable unless required by law
• Subscriptions auto-renew unless cancelled
• You can cancel anytime via your account settings
• Cancellation takes effect at the end of the current billing period
• We reserve the right to change pricing with 30 days' notice

4.4 Refund Policy

Refunds are generally not provided due to the digital, instant nature of our service. However, we may offer refunds at our discretion for:

• Technical issues preventing service use
• Billing errors
• Duplicate charges

Contact support@tattoored.com within 7 days of purchase for refund requests.

5. Acceptable Use Policy

5.1 Prohibited Content

You may NOT use TattooRed to generate or request designs that:

• Depict illegal activities, violence, or harm to individuals or groups
• Contain hateful, discriminatory, or offensive imagery
• Include sexually explicit or pornographic content
• Violate intellectual property rights (copyrighted logos, trademarks, celebrity likenesses)
• Promote self-harm, suicide, or dangerous behavior
• Depict minors in any inappropriate context

5.2 Prohibited Activities

You may NOT:

• Reverse-engineer, decompile, or attempt to extract the source code
• Use automated tools (bots, scrapers) to access the Service
• Resell, redistribute, or commercialize generated designs without proper rights
• Upload malware, viruses, or malicious code
• Impersonate others or create fake accounts
• Harass, abuse, or threaten other users or our staff
• Bypass rate limits or abuse the Service

5.3 Fair Use Policy (Pro Plans)

"Unlimited" generations are subject to fair use. Excessive or abusive usage may result in throttling or account suspension. Fair use is defined as reasonable personal or professional use for tattoo design purposes.

Abuse includes: bulk generation for resale, automated scripting, or usage that degrades service for other users.

6. Intellectual Property Rights

6.1 Ownership of Generated Designs

You own the commercial rights to designs you generate using TattooRed.

However:

• You grant TattooRed a non-exclusive license to display your designs in the community gallery (unless kept private on Pro plans)
• Free users agree to automatic publication in the gallery
• We may use anonymized designs for marketing, training AI models, or showcasing the platform
• Designs may be subject to AI model training to improve future generations

6.2 Platform Intellectual Property

TattooRed's technology, code, branding, logos, and AI models are our exclusive property or licensed to us. You may not:

• Copy, modify, or create derivative works
• Use our trademarks without written permission
• Frame or mirror any part of the Service

6.3 Copyright Infringement

If you believe content on TattooRed infringes your copyright, contact us at legal@tattoored.com with:

• Description of copyrighted work
• URL of infringing content
• Your contact information
• Statement of good faith belief that use is unauthorized

7. AI-Generated Content Disclaimer

• Imperfections, distortions, or anatomical inaccuracies
• Unintended patterns or artifacts
• Variations in quality or realism

You acknowledge that:

• AI-generated designs are for inspiration only
• You must consult a professional tattoo artist to refine and finalize any design
• TattooRed is NOT responsible for the quality, accuracy, or safety of tattoos based on our designs
• You use generated designs at your own risk

8. User-Generated Content

If you upload images, provide feedback, or contribute to the community:

• You retain ownership of your content
• You grant TattooRed a license to use, display, and distribute your content
• You represent that you have the rights to share the content
• We may remove content that violates these Terms

9. Disclaimers & Limitations of Liability

9.1 Service "As Is"

TattooRed is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including:

• Accuracy, reliability, or quality of AI-generated designs
• Uninterrupted or error-free service
• Suitability for any particular purpose

9.2 Medical & Safety Disclaimer

TattooRed does NOT provide medical, health, or safety advice related to tattooing.

Consult a licensed professional regarding:

• Tattoo safety, hygiene, and aftercare
• Allergies or skin sensitivities
• Health risks associated with tattooing

9.3 Limitation of Liability

To the maximum extent permitted by law, TattooRed and AI Innovate Solutions shall NOT be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from use or inability to use the Service
• Third-party actions (tattoo artists, other users)

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months prior to the claim, or £100 (whichever is greater).

10. Indemnification

You agree to indemnify and hold harmless TattooRed, AI Innovate Solutions, and our affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of generated designs
• Infringement of third-party rights
• Your conduct on the platform

11. Privacy & Data Protection

Your use of TattooRed is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using the Service, you consent to our data practices as described in the Privacy Policy.

12. Modification of Service & Terms

12.1 Service Changes

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service
• Change features, pricing, or subscription plans
• Update AI models or algorithms

We will provide reasonable notice of material changes when possible, but are not obligated to maintain any specific features.

12.2 Terms Changes

We may update these Terms at any time. Changes will be effective upon posting with an updated "Last Updated" date.

Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Termination

Either party may terminate this agreement:

• You: Delete your account anytime via account settings
• Us: Suspend or terminate your account for Terms violations

Upon termination:

• Your access to the Service ends immediately
• We may delete your data (see Privacy Policy for retention)
• No refunds for partial billing periods (unless required by law)
• Sections 6 (IP Rights), 9 (Disclaimers), 10 (Indemnification), and 14 (Governing Law) survive termination

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

14.2 Dispute Resolution

If a dispute arises:

• First: Contact us at legal@tattoored.com to attempt informal resolution
• If unresolved: Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales

14.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

15. Miscellaneous

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and TattooRed
• No Waiver: Failure to enforce any provision does not waive our right to enforce it later
• Assignment: You may not transfer your rights under these Terms. We may assign our rights to a successor entity
• Third-Party Services: Links to external sites (social media, payment processors) are governed by their own terms
• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control (natural disasters, pandemics, etc.)
